What the complaint alleges
The complaint alleges Lanham Act trademark infringement, unfair competition, and dilution, among other counts. It alleges that Silas Wilson's OVRKAST mark is a colorable imitation of OUTKAST. It alleges that High Schoolers owns OUTKAST Registration Nos. 2,597,623, 2,731,201, and 4,339,716, and that those three registrations are incontestable. Count I alleges infringement under Section 32(1). Count II alleges unfair competition and false designation of origin or sponsorship under Section 43(a). Count III alleges dilution under the Lanham Act.
The complaint also alleges breach of a settlement to rebrand as OVERKXST. It alleges that counsel sent a cease-and-desist letter on June 18, 2025, that the parties then negotiated a permanent stop to OVRKAST and a move to OVERKXST, and that the phase-out deadline was extended to July 15, 2026. It alleges that High Schoolers sent a finalized settlement agreement on April 10, 2026, that Wilson did not sign it, and that on July 13, 2026 he asked to use other names instead. It alleges he was bound anyway and kept using OVRKAST. That contract story is what the complaint alleges. A court has not decided whether an unsigned agreement binds him.
