What the complaint alleges
The complaint alleges that Fricker's has used its FRICKIN' mark for food, beverages, and merchandise offered at its restaurant franchise since at least 1992, and that it owns federal registrations for FRICKIN' and other FRICKIN' marks. It alleges that Frikn Coffee uses and registered POWERED BY FRIKN for energy drinks enhanced with coffee, U.S. Registration No. 7,108,619.
Count I alleges trademark infringement under 15 U.S.C. § 1114. Count II alleges unfair competition, false designation of origin, and false advertising under § 1125(a)(1). The complaint also pleads Oklahoma deceptive-trade-practices, unfair-competition, and unjust-enrichment theories. It alleges that on November 29, 2021 the USPTO refused Frikn Coffee's applications for FRIKN (stylized) and FRIKN COFFEE for likelihood of confusion with Fricker's registered marks, that Fricker's answered a later request for consent by objecting to any FRIKN mark, and that on December 18, 2023 Fricker's petitioned the TTAB to cancel the POWERED BY FRIKN registration, a proceeding the complaint says has not concluded. The prayer asks the court to cancel Registration No. 7,108,619 under 15 U.S.C. § 1119.
